Please carefully read these sales and usage conditions as they contain important information regarding your rights, remedies, and obligations. They include various limitations and exclusions as well as a clause governing the jurisdiction and competent venue in case of disputes. Placing any order implies full and unconditional acceptance of these terms.

Article 1 – General:

These general terms of sale specify conditions for ordering, payment, delivery, and handling potential returns of products ordered by customers on the protectamp.com website. Placing an order on protectamp.com for one or more products, choosing and validating a payment method during the ordering process, implies the prior consultation of these general terms of sale and the customer’s automatic, irrevocable, and unconditional adherence to these conditions.
Therefore, the customer acknowledges being fully informed that their agreement to the content of these general terms of sale does not require the handwritten signature of this document, as the customer wishes to order the presented products online. No specific condition can prevail over these general terms of sale unless formally and in writing accepted by Belledonne Piquage. The fact that Belledonne Piquage does not invoke, at a given time, any of the provisions of these general terms of sale cannot be interpreted as a waiver of subsequently invoking any of these provisions. Belledonne Piquage reserves the right to modify these general terms of sale at any time, subject to displaying these modifications on the protectamp.com website.

Article 2 – General Description of Products:

To allow the customer to know the products they wish to purchase before ordering and in accordance with Article L 111-1 of the Consumer Code, Belledonne Piquage presents on the protectamp.com website the characteristics of custom-manufactured amplifier and speaker protection covers offered for sale. Additionally, the customer can always contact ProtectAmp / Belledonne Piquage by email, phone, or mail to obtain additional information about the products and services offered. The texts and photographs describing and illustrating the presented products are not contractual. Therefore, Belledonne Piquage’s responsibility cannot be engaged in the event of an error in any of these photographs or texts. Belledonne Piquage reserves the right to modify products or their characteristics on the protectamp.com website without prior notice. The choice and purchase of a product are solely the customer’s responsibility.

Article 3 – Prices:

The sale prices of the products on the site are in Euros (€), all taxes included (VAT). Delivery costs are borne by the customer, and their amount is indicated at the time of cart validation. Delivery costs vary depending on the type of products ordered. The customer will always be informed before the final recording of their order of the delivery costs related to their order, and payment will be requested for the total amount of the purchase. Therefore, the choice and validation of a payment method by the customer imply their acceptance of paying the relevant delivery costs. Delivery costs cannot constitute a valid reason to challenge the order after its final recording.

Article 4 – Placing an Order:

Orders placed on the protectamp.com site engage the customer irrevocably. This implies that the customer has ensured that the dimensions provided via the dedicated form are accurate and comply with ProtectAmp’s measurement recommendations. The perfect realization of a custom cover depends directly on this data, and the customer is solely responsible for the information transmitted. Any order will be confirmed by sending the customer a confirmation email.

Article 5 – Manufacturing Lead Times:

Manufacturing lead times are generally 3 weeks from the order validation. These lead times are provided for indicative purposes and may vary depending on parameters specific to Belledonne Piquage’s activity. Exceeding manufacturing lead times can in no case give rise to damages or commercial discounts, nor justify the request for order cancellation.

The “express manufacturing” option guarantees the priority processing of the order and the departure of the product from our workshop within a maximum of one week from the order validation. This option does not include the delivery time by the carrier. Force majeure: ProtectAmp and Belledonne Piquage cannot, under any circumstances, have their liability engaged for any failure to fulfill their contractual obligations in the event of force majeure for the following events, and their enumeration cannot be exhaustive: internal or external strikes, disasters, delay in our supply, and, in general, any event affecting and making it impossible to execute orders normally.

Article 6 – Shipment and Carrier:

The product is shipped promptly as soon as its production is completed. An email confirming the shipment is then sent to the customer. Transportation is handled by La Poste through Colissimo with tracking and against signature, or by Mondial Relay with various delivery options (pickup points or home delivery) depending on the destination country (France, Belgium, Luxembourg, Netherlands, Germany, Austria, Italy, Spain, Portugal).

Article 7 – Receipt of Goods:

Upon receiving the package, it is the customer’s responsibility to check its condition and make any necessary reservations with the carrier. Claims regarding apparent defects, damages (not attributable to the carrier), or non-conformity of the delivered product must be communicated within 48 hours of receiving the package, by email to the following address: contact@protectamp.com. It is the customer’s responsibility to provide all supporting documents that can prove the reality of the observed defects or anomalies. Any claim not made according to the defined rules above will not be considered and will release ProtectAmp and Belledonne Piquage from any liability towards the customer. However, in the case of a manufacturing defect or an anomaly attributable to ProtectAmp and having previously been discussed between ProtectAmp and the customer, a return of the product will be organized. Exchange and shipping costs are borne by ProtectAmp, except in the case where it turns out that the returned product does not correspond to the original declaration made by the customer.

Article 8 – Right of Withdrawal:

Given the nature of our products made to customer specifications, and in accordance with Article L.221-5 of the Consumer Code, our custom covers do not benefit from any right of withdrawal. “Made-to-order” products cannot be returned or exchanged. For this reason, we recommend our customers to verify the dimensions they provide before validating the order form.

Article 9 – Invoicing:

After order validation, a detailed invoice can be consulted and printed by the customer directly on the protectamp.com website in the “My Account” section.

Article 10 – Payment Methods and Security:

The payment of the total amount corresponding to the ordered product or service, including delivery costs, will be due in full by credit card, Paypal, or bank transfer when the product order is concluded, i.e., upon receiving the order confirmation. For this purpose, with each order, the customer must provide the required information as mentioned on the website. No order will be accepted or confirmed until the required payment information has been communicated and validated. Payment by credit card: Payment is made on the secure banking server of our partner Stripe.

Article 11 – Personal Information:

The information requested from the customer is necessary for processing their order and may be communicated to contractual partners of ProtectAmp and Belledonne Piquage involved in the execution of this order. In the absence of express opposition on their part, the buyer gives their consent to the use of personal data collected at the time of their order, under the customer file of ProtectAmp. In accordance with Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, the customer has the right to access and rectify their personal data at any time. To exercise this right, they must send their request to ProtectAmp.

These General Terms and Conditions of Sale are governed, both for their interpretation and for their execution, by French law. In case of a dispute, the customer will first contact ProtectAmp / Belledonne Piquage to seek an amicable solution. Any dispute relating to the formation, execution, and termination of contractual obligations between the parties that cannot be settled amicably will be submitted to the jurisdiction of the commercial court of Grenoble, within the jurisdiction of which the seller’s headquarters are located.
